Warsaw man convicted of firearm possession as unlawful drug user

A federal jury has convicted Gary Schmucker, 47, of Warsaw, Indiana, on a charge of possessing a firearm as an unlawful drug user. The verdict was reached after a two-day trial overseen by United States District Court Judge Damon R. Leichty in South Bend.

Sentencing for Schmucker is set for November 25, 2025, at 10:00 AM. The sentence will be determined by the District Court Judge in accordance with federal statutes and the United States Sentencing Guidelines.

The Bureau of Alcohol, Tobacco, Firearms and Explosives led the investigation into the case with support from the Kosciusko County Sheriff’s Department. Assistant United States Attorneys Joseph P. Falvey and Jerome W. McKeever prosecuted the case.

According to Acting United States Attorney M. Scott Proctor: “Late yesterday, Gary Schmucker, 47 years old, of Warsaw, Indiana, was found guilty after a two-day jury trial presided over by United States District Court Judge Damon R. Leichty.”

The prosecution is part of Project Safe Neighborhoods (PSN), which coordinates law enforcement agencies and community groups to address violent crime and gun violence. In May 2021, the Department introduced a new strategy for PSN focused on building trust within communities, supporting organizations that work to prevent violence before it happens, prioritizing strategic enforcement efforts, and tracking results (https://www.justice.gov/opa/pr/department-justice-launches-new-effort-reduce-violent-crime).
